In his first book, law professor and philanthropist Fleishman has created a thoughtful, engrossing, comprehensive guide to the origins, initiatives, successes and failures among the largely unsung 68,000 private foundations in America, which together grant over 32.2 billion tax-exempt dollars per year.

Tracing the history of this distinctly American institution, Fleishman considers the philanthropy of such financial titans as Andrew Carnegie, George Soros, Warren Buffett, Michael Milken and Bill Gates. Fleishman’s view of the foundation is distinctly favorable: foundations serve a vital social function by providing seed funding to innovative initiatives, having led to such benefits as the 911 emergency response system, the development of the Pap smear, the alleviation of poverty in Bangladesh and the establishment of Johns Hopkins and Carnegie Mellon Universities.

Fleishman doe not hestitate, however, to criticize foundations for arrogance, poor planning, unresponsiveness, waste and irresponsibility, using 12 case studies-Rockefeller’s Population Council and the Children’s Television Workshop among them-to set the stage for "Some Not So Modest Proposals," most of which involve increasing transparency and accountability. Joel L. Fleishman is professor of law and public policy at Duke University and the author of The Foundation. He has served as president of the Atlantic Philanthropic Service Company, the U.S. program staff of Atlantic Philanthropies.

Joel Fleishman’s book lays an excellent bedrock of history underneath its discussion of philanthropy as a great element of American tradition. We live in days of some staggering examples – from Warren Buffet’s living bequest of billions, to the fine work of Bill and Melinda Gates – and many others. But rather than see this as some product of the new millennium – Fleishman shows how the new avatars of corporate generosity are following a fine tradition. More than this, the author shows that certain gifting strategies have been leveraged for huge social benefit. For those who are thinking – at whatever scale – of giving to support a cause, this book sets out the strategies that have produced most benefit. This is an excellent, thoughtful piece of work on a topic that currently has wide currency. Well worth reading.

******Examining a Big but Little Known Area March 8, 2007

Foundations are a subset of Non-Profit organizations that have become surprisingly big busines in the United States. Somewhere around 1/7th of the business in the country is conducted by these organizations. Somewhere around 1/9th of the workforce is employed by one. They have become an integral part of the American economy.

In this book Mr. Fleishman looks at Foundations (a number of which he has been associated as employee, trustee or some other capacity). He examines what makes a foundation successful, and how some have failed. He offers insight and advice on how to make a foundation more successful, and at the same time how foundations should have an obligation to become more accountable since they received special tax considerations from the Government. He suggests that this accountability should be done by the foundations voluntarily. However, Mr. Fleishman is an attorney and believes that if voluntary response is not forthcoming then new legal requirements should be placed upon them to require more openness.

—Acheson bought this house in 1922 without ever having seen the inside. He and his wife, Alice, fell for it at first glance but they didn’t want to disturb the occupants so they wrote asking if it were for sale. The occupants said they were about to move out so the Achesons bought it and only stepped inside after the others left.

—Acheson gave a farewell party lunch party here on the Harry Truman’s last day in office. Hundreds of cheering fans gathered in the street. Truman later wrote to Acheson saying that he had never been to a such a party "where everybody seemed to be having the best time they ever had"

—In the 1930′s, the Acheson’s planned on moving to a larger house but their three (3) children objected, saying all their friends were in the neighborhood, so the parents stayed and enlarged the house with three floors in the front and back and two floors in middle connected by arched windows.

—Acheson is buried beside the Renwick Chapel in Oak Hill Cemetary (a short distance from this house).

—His wife, Alice, was an accomplished painter whose works were exhibited at the Corcoran Gallery of Art as well as in the Phillips Collection.

—Alice lived to be 100 years old, she died in 1996.

Dean Gooderham Acheson (April 11, 1893 – October 12, 1971) was a prominent lawyer whose career included many stints in United States government service, culminating as United States Secretary of State under President Harry S. Truman. In these various capacities he played a central role in the creation of many important institutions including Lend Lease, the Marshall Plan, the United Nations, NATO, the International Monetary Fund and the World Bank, together with the early organizations that later became the European Union and the World Trade Organization. He presided over United States diplomacy during several important crises of the early Cold War, including the Korean War.

Acheson’s career also was marked by controversy. Although he developed anti-Communist views early in his political career, Acheson was a prominent defender of State Department employees accused during Senator Joseph McCarthy’s anti-Communist investigations. Acheson was also instrumental in the prehistory of the Vietnam War, having persuaded Truman to dispatch aid to French forces in Indochina, but later counseled President Lyndon B. Johnson to negotiate for peace with North Vietnam. During the Cuban Missile Crisis, President John F. Kennedy called upon Acheson for advice, bringing him into Kennedy’s executive committee (ExComm).

Early Life and Career
Dean Acheson was born in Middletown, Connecticut. His father, Edward Campion Acheson, was an English-born Church of England priest who, after several years in Canada, moved to the US to become Episcopal Bishop of Connecticut. His mother, Eleanor Gertrude Gooderham, was a granddaughter of prominent Canadian distiller, William Gooderham (1790-1881), founder of the Gooderham and Worts Distillery.

Acheson’s primary schooling was at Groton School, at which Acheson did not enjoy, nor did he perform very well, scoring largely average marks during his time there. Later Acheson was educated at Yale University (1912-15), where he became a member of the prestigious secret society, Scroll and Key. It was not until Acheson entered Harvard Law School, where he attended from (1915-18) that the future Secretary of State became studious. At the latter he became a protege of the professor Felix Frankfurter, who taught Administrative Law Courses at the Law School. Acheson also attended law school with future luminaries such as John J. McCloy who got him a job in Washington. At that time, a new tradition of bright law students clerking for the U.S. Supreme Court had been begun by Supreme Court Justice, Louis Brandeis for whom Acheson clerked for two terms from(1919-21). Frankfurter and Brandeis were close associates, and future Supreme Court Justice Frankfurter suggested that Brandeis take on Acheson.

Economic Diplomacy
A supporter of the United States Democratic Party, Acheson worked at a law firm in Washington D.C., Covington & Burling, often dealing with international legal issues before Franklin Delano Roosevelt appointed him as Undersecretary of the United States Treasury in 1933. Acheson did not stay in this post long, as he and President Roosevelt found themselves at loggerheads over FDR’s plans of changing the price of gold. Much of this Acheson recounted in his book, "Morning and Noon." Later, FDR would bring Acheson back into his administration, placing Acheson in the State Department. There Acheson developed much of the economic warfare waged by the United States against the Axis Powers prior to its formal entry into World War II, including the embargos that led to the 1940 diplomatic crisis with Japan and its subsequent 1941 attack on Pearl Harbor. In 1944, Acheson attended the Bretton Woods Conference in New Hampshire as the head delegate from the State Department. At this conference the post-war international economic structure was designed. This conference was the birthplace of the International Monetary Fund, the World Bank, and the General Agreement on Tariffs and Trade, the last of which would evolve into the World Trade Organization.

Cold War Diplomacy
Later, in 1945, Harry S. Truman selected Acheson as his Undersecretary of United States Department of State, working under Secretaries of State Stettinius, Byrnes, and Marshall. Often during the post-war period, the Secretary was overseas, and Acheson was the acting Secretary attending Cabinet meetings. During this period, Acheson cemented a very close relationship with President Truman. Over the next two years, Acheson played an important role in devising both the Truman Doctrine and the European Recovery Program. Acheson believed that the best way to halt the spread of communism was by helping rebuild a functioning economic structure in Western Europe.

In 1949, Acheson was appointed Secretary of State. In this position he built a working framework to the policy of the containment, first formulated by George Kennan, who served as the head of Acheson’s Policy Planning Staff. Acheson played instrumental part in the formation of NATO, and is the signer to the pact for the United States. The formation of NATO was a great departure from established U.S. foreign policy, in which the United States would refrain from ‘entangling alliances.’

"The Attack of the Primitives"
The failure of the United States to prevent the communist takeover of mainland China in 1949 precipitated several years of organized opposition to Acheson’s tenure, a period to which Acheson refers in his outspoken memoirs as "The Attack of the Primitives." Although he maintained his role as a firm anti-communist, he was attacked by various anti-communists for not taking a more active role in attacking communism abroad and domestically, rather than a mere containment of communist governments. Both he and Secretary of Defense George Marshall came under attack from men such as Joseph McCarthy; Acheson became a byword to some Americans, who tried to equate containment with appeasement. Richard Nixon, who later as President would call on Acheson for advice, would complain of "Acheson’s College of Cowardly Communist Containment." This criticism grew very loud after Acheson refused to ‘turn his back on Alger Hiss’ when the latter was accused of being a Communist Spy, which was later proved by the Venona Project.

On December 15, 1950, the Republicans in the House of Representatives resolved unanimously that he be removed from office, to no avail. Furthermore, Acheson also upset the right wing when he took the side of Harry S. Truman in his dispute with General Douglas MacArthur over the Korean War. Acheson and Truman wanted to limit the war to Korea, whereas MacArthur called for the extension of the war to China.

Return to Private Life
After the 1952 presidential campaign, Acheson returned to his private law practice. Although his official governmental career was over, his influence was not. Acheson headed up Democratic Policy Groups during the Eisenhower years. Much of President Kennedy’s flexible response policies came from the position papers drawn up by this group.

Acheson’s law offices were strategically located across Lafayette Park from the White House and he accomplished much out of office. He became an unofficial advisor to the Kennedy, Johnson, and Nixon administrations. In 1964, he received the Presidential Medal of Freedom. In 1970, he won the Pulitzer Prize for History for his memoirs of his tenure in the State Department, Present at the Creation: My Years in the State Department.

In 1971, Dean Acheson died of a massive stroke at his desk on his farm in Sandy Spring, Maryland at the age of 78.

I noticed this couple, sitting on the railing that separates the vehicular roadway from the pedestrian part of the Piazza del Popolo. I couldn’t tell if they were arguing, engaged in a who-blinks-first? contest, or just having a thoughtful conversation…

I can’t help wondering if this couple had any idea how many people would look at their picture (a little over 14,000 as of January 2012), and how many different bizarre blog postings — well over a hundred, at this point, from all over the world — would use the image of their conversation to illustrate their message. I refer to your email of 12 July and apologise for the delay in replying.

The extensions to 372 are essentially in four elements:
? The nearest ground floor extension
? The nearest first floor extension
? The farthest ground floor extension
? The farthest first floor extensions.

In the past it was always considered that the nearest ground floor addition was established or even an original part of the building. However later plans submitted during the latest planning appeal seem to support the view that the whole ground floor additional is unauthorised. This argument was accepted by the Court which in part led to the defendants acquittal.

(1) "Following my bringing this unauthorised development to the attention of Haringey Planning Service in October 2005, retrospective planning permission was refused."

This is correct and an Enforcement Case was opened when you reported this matter on 28th October 2005. Retrospective planning application HGY/2005/2009, received on 26 November 2005. This was refused on 20th December 2005. An appeal against the decision was dismissed by letter on 11th December 2006. Another planning application to retain the development (part 1st floor and two storey rear extension) was also refused and was not appealed on 15th May 2006.

As stated previously an Enforcement Notice was served on the two storey rear extension in 2006. This related to the rearmost part of the two storey extension not the part closest to the frontage of Tottenham High Road.

(2) "Haringey Planning Service defended Appeal and the Council won the case, appeal dismissed on 11/12/06"!

(3) "Having won, Haringey went to Court to enforce, but messed-up the case so badly that we lost."

On 30th October 2007 prosecution for non-compliance with the Enforcement Notice was heard in the Magistrate Court today. It was adjourned and the owner pled not guilty. On 19th March 2008 he defendant was acquitted – Magistrates found in favour of the defendant as it was not certain that the entire two storey extension was unauthorised given that a 1991 permission for a ground floor extension and restaurant existed and the Court was satisfied that the ground floor element was immune from enforcement action. There was then a need to serve a fresh Enforcement Notice. However the Court decision severely limited what action could be taken.

"(4) Haringey Planning then issued a Certificate of Lawfulness on part of the same building.".

This was granted on 16th October 2007 under HGY/2007/1671 relates to the first floor nearest the original built on what was thought to be an original ground floor addition. Evidence form Council’s Building Control Service indicates that this work was commenced in 1995 Sworn affidavits from the owner and neighbours atest to the 1st floor being in situ from at least 2000. This was not covered by the Enforcement Notice and therefore not affected by it.

(5) "As far as I can tell, despite my being a ward councillor and having taken a specific interest in these premises, I was not told about (3) and (4)"

I apologise on behalf of Planning Enforcement for not notifying you in relation to the matters raised in your note (3) above. In relation to your note (4) in relation to the certificate of lawfulness at the time the application was considered you will recall that the Planning Service did not consult in relation to this time of application as it was considered that the applications were dealt with on the basis of evidence and not on judgements of planning matters.

(6) "Haringey Planning Service refused a further application from the owner."

This is correct. However this related to the first floor of the extended premises only. It was under Ref HGY/2007/2622 and refused on 5th February 2008 for conservation area reasons and amenity harm to near by occupiers. In the Inspector’s report he as of the opinion that the information suggested that the entire ground floor was established being built around about 1991. With this being so and a CoL granted for the nearest first floor extension only the farthest first floor element was enforceable.

(7) "Haringey Enforcement Service then decided to take no action."

The key difficulty therefore with enforcement after the Court decision was that only the 1st floor of the rearmost extension could have been enforced in terms of operational development and required to be removed. Although it does appear that both the ground and rear floors could be enforced in terms of the change of use to residential, the removal of just the first floor through compliance would be in my opinion a poorer quality building than what is existing.

Another factor is that 372-376 High Road have all been substantially extended to the rear and that further enforcement action would not have been proportionate or expedient given the limited outcome of what could have been achieved through compliance. With these limiting factors it was with some regret that the case was considered for closure in 2008.

In summation had all facts been known at the outset of your complaint we may have been able to have undertaken more efficient enforcement action and drafted out notices accordingly. The establishment of the entire ground floor as accepted by the Court also significantly lessens the degree of unauthorised development. Certainly our preparation for Court could have been better. The case appears to have suffered from a lack of continuity which has hampered effective enforcement action. In the last two years measures have been put in place to ensure that more through investigations improved updating of complainants and better scrutiny with regard to drafting notices and prosecution preparation to minimise the chance of such matters happening again. In addition improved co-ordination of working with Development Management has improved the decision making process in the last two years.

(a) "How often do similar sequences of events occur?"

I can only think of one other acquittal. This was where there was strong pressure to prosecute against our advice (the matter had been reduced to within permitted development rights and the Court agreed that the defendant had no case to answer.

(b) "How often do they occur in: (i) Tottenham and (ii) areas such as Highgate?"

With regard to problems arising due to lack of continuity I can think of two cases which like 372 High Road were older cases where delay, change of personnel and lack of continuity prejudiced our ability to effectively regularise matters with through enforcement or through the planning process. One of these occurred in Seven Sisters ward and the other in Bounds Green Ward from case dating from 2003.

(c) "Can you please tell me what purpose is served by the Tottenham Conservation Areas?"

The purpose, as with all designated Conservation Areas, is to protect and enhance the character and appearance of the physical environment within the area defined by the Conservation Area.

Today I received a reply to my Member Enquiry sent on 12 July 2010.

Can you please tell me who drafted this reply and whether or not they were legally qualified in Planning Law? If not, can I please ask that the papers are now reviewed by an appropriate officer from the Legal Service.

I do not accept that there are "four elements" to this building. Quite plainly there are at most three. They are:
? The nearest ground floor extension; ( i.e. nearest to the original building)
? The nearest first floor extension;
? The furthest extension to both ground and second floor.

This third ‘element’ was constructed as a single block in 2005. Please see the attached photo which I took on 19 May 2005. This and two more are posted on Flickr.

At the time I failed to spot that Planning Permission had not been applied for. I’d assumed – wrongly – that [Haringey] Building Control would not have permitted ‘stopping-up’ the pavement for unauthorised building works.

I cannot understand the apparent argument that because the whole ground floor extension – all three ‘elements’ – may have been unauthorised, this somehow prevents legal action being taken against the furthest extension to both ground and second floors – i.e. the extension I reported and photographed.

Can I draw attention to the answer given to my question about the purpose of the Tottenham Conservation areas. I was told this is:
"to protect and enhance the character and appearance of the physical environment within the area defined by the Conservation Area."

Oddly, that was also my assumption. Now please read the Inspector’s decision on 372 High Road and his highly critical verdict on the furthest extension at ground and first floor levels.

May I please request a reply a little more speedily this time.
